
Terms and Conditions of Stay
Licence to Occupy – Campground Site
1. Nature of Accommodation – Licence Only
- 1.1Parking on Pearson operates as a campground/holiday park providing sites for caravans, campervans, motorhomes, tents, and other moveable accommodation.
- 1.2All stays are provided strictly under a revocable licence to occupy a site, not a lease or residential tenancy.
- 1.3Nothing in these Terms creates:
A residential tenancy;
A lease;
Exclusive possession of land; or
Any legal interest in land.
- 1.4Guests are licensees only. Parking on Pearson retains full possession, control, and management of all sites and the campground at all times.
- 1.5The campground is not offered as permanent housing and is not intended to be used as a person's principal place of residence.
2. Maximum Stay and Break Requirement
- 2.1The maximum continuous stay permitted at Parking on Pearson is 28 days.
- 2.2At the end of a maximum stay period, the guest must:
Vacate the campground entirely; and
Remove all vehicles, caravans, equipment and personal belongings.
- 2.3A minimum break of 7 consecutive days outside the campground is required before any new booking may be approved.
- 2.4Any new stay after a break:
Is subject to availability;
Requires a new booking approval; and
Does not create any right of renewal or continuation.
- 2.5Parking on Pearson may decline repeat bookings at its sole discretion.
3. Allocation of Sites (No Exclusive Possession)
- 3.1Guests are allocated a site for the booked period only.
- 3.2Parking on Pearson may, at any time and for operational reasons, require a guest to relocate to another site within the campground.
- 3.3Guests must comply with relocation requests within the timeframe specified.
- 3.4No guest has exclusive possession or control of any particular site.
4. Residential Address Prohibition
- 4.1Parking on Pearson sites may not be used as a permanent residential address.
- 4.2Guests must not use the campground as:
Their registered address for electoral enrolment;
A driver licence address;
An IRD or banking address;
A postal or courier delivery address; or
Any similar official or governmental registration.
- 4.3Mail delivery is not guaranteed and may be refused or returned.
5. Bookings and Payment
- 5.1All stays must be paid in advance.
- 5.2For stays longer than 7 days:
An initial advance payment equal to one week's site fees is required; and
At all times, at least one week's site fees must remain paid in advance.
- 5.3Failure to maintain advance payment may result in immediate cancellation of the stay and requirement to vacate.
- 5.4All additional charges (power, extra persons, damage, cleaning, etc.) are payable immediately on demand.
6. No Bond / Advance Payments
- 6.1Parking on Pearson does not take or hold a residential tenancy bond.
- 6.2Any advance payment:
Secures occupation only for the prepaid period; and
May be applied to unpaid charges, damage, cleaning, or removal costs.
- 6.3Refunds of unused site fees are subject to clause 7.
7. Cancellations and Early Departure
- 7.1Cancellation terms:
More than 7 days before arrival – refund less admin fee of $20.
Within 7 days or after arrival – retention of up to one week's site fees.
- 7.2Early departure refunds are at the sole discretion of Parking on Pearson.
- 7.3If a stay is terminated due to breach, no refund is payable except as required by law.
8. Behaviour, Structures and Use of Site
- 8.1Guests must comply with all campground rules.
- 8.2No permanent or semi-permanent structures may be erected, including:
Decks
Fixed awnings
Fencing
Storage sheds
Plumbing connections
Fixed landscaping
- 8.3Only moveable, temporary camping equipment is permitted.
- 8.4Long-term storage of goods is not permitted without written approval.
- 8.5Sites must be kept tidy and capable of immediate relocation if required.
9. Termination of Licence
- 9.1Parking on Pearson may revoke this licence and require a guest to vacate immediately or within a reasonable timeframe if:
Site fees are overdue;
These Terms or campground rules are breached;
Behaviour is unsafe, threatening or disruptive;
Directions from authorities require closure or evacuation;
The maximum stay period has expired.
- 9.2Upon termination:
The guest must remove all property promptly.
Failure to do so may result in removal or towing at the guest's cost.
- 9.3Termination under this clause does not create any tenancy rights.
10. Damage and Liability
- 10.1Guests are responsible for all damage caused by themselves or visitors.
- 10.2Vehicles and personal belongings remain at the guest's risk.
- 10.3Nothing in these Terms limits rights under the Consumer Guarantees Act 1993 or other non-excludable laws.
11. Privacy
- 11.1Personal information is collected for booking, payment, safety and legal compliance.
- 11.2The Privacy Policy of Parking on Pearson applies.
12. General
- 12.1By booking or staying, guests accept these Terms and campground rules.
- 12.2Parking on Pearson may amend these Terms by publishing updated versions.
- 12.3If any clause is invalid, the remaining provisions continue in force.
